LYNN – A judge ordered $500 cash bail for each of two city teens a prosecutor said brutally attacked another teen in broad daylight and robbed him of his cell phone.But defense attorneys questioned whether the attack even happened, noting police did not report any injuries sustained by the alleged victim.”He says he was punched several times on the head, but police found no evidence of that and the man refused treatment, according to police reports,” Attorney Joseph Finn said in Lynn District Court Wednesday.Cody B. Walsh, 18, of 97 Brookline St., and Markus Garner, 18, of 71 Birch St., were each arrested and charged with unarmed robbery; and assault and battery; at 12:23 p.m. Tuesday.They were each arraigned on the charges Wednesday in Lynn District Court and not-guilty pleas were entered for each.Police responded to Williams Avenue at 11:37 a.m. Wednesday, where the alleged victim told officers he was walking down the street when he noticed two men behind him, Assistant District Attorney Doug Sheehan told the court. The alleged victim took out his cellphone and the men attacked, punching the alleged victim several times on the head and bringing him to the ground, Sheehan said. He said the alleged victim told police he saw the assailants pick up his cellphone from the ground and then run away.The alleged victim identified Garner – who lived nearby – as one of the assailants and described the other as a white man with long brownish hair and tattoos on both arms, according to Sheehan and a report by Lynn Police Officer Jerren Griffin.Police subsequently found Garner among a group of people including a man – later identified as Walsh – who matched the victim’s description of the second alleged assailant, according to police.Sheehan told the court the alleged victim was “100-percent sure” when he later positively identified both defendants. He said police did not find the cell phone on the defendants but they had plenty of time to get rid of it.Sheehan requested $5,000 cash bail for each defendant, saying they “committed a brutal attack on an unsuspecting man in broad daylight.”He also requested Walsh’s bail be revoked on a previous breaking-and-entering changes, saying Walsh had “graduated from breaking into cars to viciously attacking people and stealing their cell phones.”But defense attorneys requested the defendants be released on personal recognizance.Both suspects denied being on Williams Avenue, had no idea about any alleged robbery, and said multiple witnesses would vouch for their respective alibis, attorneys said.”I don’t believe there’s any real evidence connecting him to these alleged crimes,” Finn said.Attorney Chris Mangos, representing Garner, noted the alleged incident occurred in a highly populated area in the middle of the day, but there were no other witnesses.Judge Ellen Flatley ordered $500 cash bail for each defendant and denied the request to revoke Walsh’s bail.She scheduled the defendants to return to court Sept. 12.
