LYNN – Police arrested a Lynn man Monday afternoon on domestic assault and battery charges just two hours after a District Court judge ordered him released following an arrest for similar charges on Sunday, according to court records.Judge Albert Conlon ordered Anthony Gubitosi, 35, of 41 Light St. #28 released on personal recognizance Monday on the condition that he have no contact with his father, the alleged victim. But Lynn Police arrested Gubitosi again around 1 p.m., again charging him with assault and battery, along with assault and battery with a dangerous weapon and threat to commit a crime.Assistant District Attorney Katelyn Giliberti alleged that soon after being released from District Court on Monday on charges that he punched his father in the face, Gubitosi returned to his father?s house and again assaulted him as the two argued over a scooter. He then fled on a scooter, striking a pregnant woman, who is his cousin, in the process, Giliberti said.Giliberti requested that the judge revoke Gubitosi?s bail on the first case, which would result in an automatic 60 days in jail, and hold him on $1,000 on the new charges, but Judge James Lamothe said he felt incarceration was “not the right thing” for Gubitosi after a sidebar conversation with his court-appointed attorney, Victoria Raneiri.Police responded to a Henry Avenue home around 1 p.m. Tuesday after numerous callers reported two males fighting in the street, according to a Lynn Police report. Gubitosi?s father told officers that his son had come to the house, against court orders, to take the scooter, the report said.Gubitosi allegedly pushed the 53-year-old man to the ground before fleeing on the scooter and running into the pregnant woman. The 34-year-old woman said she believed Gubitosi struck her intentionally, according to the report.Lamothe again ordered Gubitosi released, but said he must submit to a mental health evaluation and have no contact whatsoever with any of the alleged victims.While awaiting arraignment in the prisoner?s dock Monday, Gubitosi allegedly put his cuffed hands together in a gun shape and mimicked shooting members of the gallery, just out of view of the judge and court officers.He is due back in court for both cases on Aug. 21, according to court records.Taylor Provost can be reached at [email protected].
