SALEM – A Lynn man and a Boston resident were indicted Friday afternoon on separate cases involving rape, indecent assault and battery and larceny crimes by an Essex County grand jury.Maiky Aponte, 20, of 14 McKinley Ter., Lynn, is charged with rape and larceny of property over $250 stemming from an incident in Lynn on Aug. 6 when he allegedly raped a 19-year-old Beverly woman in a Lynn home on Nichols Street and then allegedly stole her cell phone.The woman told authorities she was picked up by her friend who had two other occupants in the car at the time and they took her to the home on Nichols Street where she was raped in the basement by the accused.Following the incident they reportedly drove her to a park in Lynn, where Aponte allegedly stole her cell phone from her. She then told authorities she was taken back to the Nichols Street home by one of the other individuals when she ran to a neighbor’s house for help.Aponte will be arraigned in Superior Court within a month.Also indicted:Edgar Amaya, 23, of 130 Trenton St., East Boston, charged with rape and indecent assault and battery on a child over 14 concerns two incidents with a 15-year-old Lynn girl he reportedly met at church.The victim told authorities she met the suspect Jan. 15 and they went to the Plaza Motel at 125 Newbury St. in Peabody where he allegedly raped her.Then on Feb. 14 they met again at a home in Lynn where he apparently indecently fondled her.A conviction on the charge of rape of a child carries a potential life sentence in state prison and indecent assault and battery on a child carries up to 10 years in state prison.Amaya is expected to be arraigned in Salem Superior Court on Jan. 26.Indictments are not an indication of guilt, rather a grand jury found sufficient evidence to warrant a jury trial in Superior Court, allowing for a more severe punishment if convicted.Assistant District Attorney Michael P. Hickey is prosecuting both cases for the state.
