LAWRENCE – A Lynn felon convicted of more drug charges was sentenced to serve three years in prison, probation for another two years when he is released and will lose his driving privileges for five years.Emery Sanders, Jr., 56, who last lived at 228 Washington St., was found guilty earlier this week by a Lawrence Superior Court jury of trafficking over 14 grams of cocaine and illegal possession of marijuana with the intent to distribute.Jurors deliberated just about one hour before reaching their decision. He was sentenced to the minimum mandatory punishment for trafficking 14 grams of cocaine – three years in prison – by Judge Leila R. Kern. However, the prison term will not commence until Sanders completes another three-year prison term he is serving on a probation violation imposed late last year. After he gets out of jail, he will be on probation for another two years with the condition that he receives drug screenings as deemed necessary by his probation officer.Assistant District Attorney Greg A. Friedholm presented evidence during the trial that on Aug. 10, 2007 police raided Sanders’ home on Washington Street and during a pat frisk on Sanders, they found 10 twists of cocaine.Additional cocaine was also found inside his shoe, a total of over 20 grams, as well as 13 packages of marijuana and $1,100 in cash, believed to be proceeds from drug sales.Police also found a scale, police scanner, plastic bags and other drug related items were also found in the apartment.Police detective Paul Holey spearheaded the investigation.Defense lawyer Michael T. Phelan tried to convince the jury that the cocaine and marijuana found was for personal use, but they thought otherwise.Sanders did not take the stand and testify in his own defense. At the time of his arrest last year, Sanders was on probation for a 1999 heroin distribution case in which he had received seven to nine years in prison to be followed by five years of probation. In October, Sanders was found in violation on the case because of his new arrest and given three years in prison, which he is now serving.
