SALEM – A Lynn construction worker accused of raping a woman in an apartment on Commercial Street after allegedly kidnapping her will have to come up with $10,000 cash in order to get out of Middleton Jail pending trial.In Salem Superior Court Thursday, Modesto Lopez-Miranda, 44, of 98 Henry St., entered his plea of not guilty to aggravated rape and kidnapping.As recommended by the prosecutor and defense, Judge Howard J. Whitehead set the high bail, but agreed the defense may seek a bail review at another court hearing.Assistant District Attorney Michael A. Patten said the charges concern an incident in Lynn on Aug. 24.According to the victim, a 34-year-old Lynn woman, shortly before 5 a.m., she was looking to buy cigarettes on Eastern Avenue. The suspect offered to give her a ride. She got into the Jeep, which had two males in the back seat, and was driven to 60 Commercial St. where she was dragged into a second floor apartment, pushed onto a mattress and forcibly raped.The victim reportedly told authorities that her attacker had a hand that was deformed.Following an investigation, police arrested Lopez-Miranda.The two other participants remain unidentified at this time, Patten said.Lopez-Miranda faces up to 30 years in state prison if convicted on both charges.His next scheduled court date is Feb. 15 for a pretrial conference.
